MINUTES OF MEETING : Barby Sporting Club Noise Nusiance.
Monday 27th September 2010 at 10am – Kilsby village Hall

Minutes: The minutes were agreed as a correct record following removal of the last sentence as Mr Paul Knight said that he had not agreed to write to BSC to ascertain what % of their business used supersonic or subsonic cartridges.
Matters Arising:
1. IM stated that he had passed case study details of other shooting clubs onto PK at DDC. These had been received by PK.
2. Construction of the bunding and noise levels will be monitored by DDC Environmental Health Officers.
3. If DDC results show noise levels greater than 70.4dB measured at Danetre Farm, then DDC Legal Team feel that it is acceptable to link a timescale to the completion of the bunding. If the completion date slips then this will alter the legal position.
CEEL asked why DDC will only alter their legal position if the noise level measured is above 70.4dB, as she understood that levels over 55dB were generally classed as noise nuisance. PK stated that this is because the construction of bunding has been taken as pursuance of “best practicable means” to mitigate noise and 70.4dB is the previously recorded level.
IM pointed out that Planning permission for shoots should not be given if the resultant noise exceeds 55dB. PK acknowledged this but said that case law and the fact that the site has operated for many years, protects BSC from this.
4. PK reported that he has visited Danetre Farm to gain permission to monitor noise levels there and to share the resultant data, and has also visited BSC to inform them that noise will be monitored by DDC from a point at Danetre Farm.
Action Points
1. PK will assign an Environmental Health student to the task of monitoring the noise. He will be employed from 25th Oct, and it is envisaged he will carry out the monitoring before Christmas.
2. PK agreed to look through other cases to see if there is anything DDC can learn from them. IM pointed out that the Welsh case is the most similar.
3. IM stated that in many cases applications for bunding were refused, as it is not proven that they reduce noise. RC said that he thought that although the bunding alone might not significantly reduce noise levels, the alteration to the line of fire should help. This was acknowledged.
4. PK was asked whether BSC could be asked to alter their line of fire partially as an interim measure so that shooting took place towards DIRFT 2. IM pointed out that this could cause ricochet of noise off the
hard vertical surfaces of the warehousing and would need to be measured to ascertain if it was of benefit to Kilsby. Details to be considered further after monitoring has taken place by DDC.
5. The difference between Supersonic and sub-sonic cartridges will be monitored when the noise levels are monitored from Danetre Farm and the Environmental Student will be tasked to consider this.
6. IM explained the detail of the Welsh case. They were required to reduce their shooting hours and use subsonic cartridges as best practicable means of reducing noise. Permission for bunding was refused as it was not proven to help in noise reduction.
7. RC asked PK for some indication of what would be considered as a reasonable timescale for completion of bunding. This will be decided following the measurement of noise levels by DDC. It was agreed that Kilsby Parish Council would write to BSC and ask them when bunding is planned for completion as although it has started there has been negligible work carried out so far.
8. It was noted that the Directors of BSC have stated that the bunding is being erected purely to reduce noise nuisance suffered by residents of Kilsby and the surrounding areas and there are no plans for an extension of shooting hours.
9. RC pointed out that Kilsby Parish Council represented the views of a large section of the parish, and made it clear to PK that most parishioners had not sent individual letters of complain about noise to DDC as they thought that the Parish Council is campaigning on their behalf.
