KILSBY PARISH COUNCIL

Minutes of the Annual Meeting of the Council held on 11th May 2010 in Kilsby Village Hall commencing at 7.45pm

Present: Councillors R Chamberlain, M Cahill, W Clark, R Dunn, M Longmore, C Mills, V Penman, E Taken. Clerk – Mrs Catherine Camp. Also present District Councillors B and C Lomax, PCSO Les Conopo.

1.Election of Chairman Rob Chamberlain was proposed as Chairman by Claire Mills, seconded by Vince Penman and in the absence of further nominations was duly elected.

2.Declaration of Acceptance of Office by Chairman was signed by the Chairman.

3.Declaration of Acceptance of Office by co-opted member was signed by Mark Longmore who was welcomed onto the Council.

4. Apologies. received and accepted from Councillors Anne Cole, Charles Smedley, Phil Martin and from County Councillor Robin Brown and PCSO Lorraine Humfress.

5. Election of Vice-Chairman Reg Dunn was proposed by Eddie Taken, seconded by Malcolm Cahill and in the absence of further nominations was duly elected.

6.Appointment of Responsible Financial Officer The Clerk, Catherine Camp was reappointed as RFO for the year 2010/11.

7.Declarations of interest

a) All Councillors reviewed their Register of Members Interests and were issued with a Flowsheet with questions to ask when ascertaining whether they need to declare an interest.

b) C Mills declared a personal and prejudicial interest in Planning Application DA/2010/0344 since her son attends Pre-School.

District Councillor B Lomax declared a personal and prejudicial interest in Planning Applications since he is a member of DDC Planning Committee and must make decisions with an open mind.

8.Minutes Of 13th April were agreed and signed as a true record of proceedings.

The Chairman closed the meeting at 8pm for reports from District Councillors and PCSO.

9. Matters Arising not covered elsewhere on the agenda (fio)

a) Speedwatch – Councillor Chamberlain reported that 220 signatures in support of Speedwatch had been collected. It was agreed to ask for Kilsby to be included in the Speedwatch programme.

Thanks to Councillors Chamberlain, Cole, Dunn and Penman who helped collect signatures.

A note to be put in Kilsby Kronickle asking for volunteers to be trained to use speedguns. CM

Councillors Cahill, Dunn, Chamberlain, Longmore volunteered to train, and Mr Mills and Mrs Chamberlain were volunteered.

10. Policing

a) Report on PCSO Policing tripartite meeting 4th May. – Councillor Chamberlain reported that Phil Martin, Phil Dunkley from Crick and the BNP representative who Manage DIRFT will meet by monthly.

Initial reports are very good and Sgt Valentine has received no negative comments. There is a steady flow of intelligence and crime figures have plummeted. He is sure the level of enthusiasm will remain on the part of the PCSOs.

Eldon Way Industrial Estate and Bakers Petfoods are benefitting without any financial contribution. Councillor Chamberlain has agreed to write to all the businesses on Eldon Way and invite them to contribute. Any contributions will be put into the general fund. RC

b) Community Payback Scheme. Crick has used the scheme and has the benefit of about 6 people with a Supervisor once per week to carry out painting and clearance jobs around the village. Cllr Longmore agreed to liaise with Crick and the Police to get jobs done in Kilsby. ML

Parishioners to be asked via KK which places could be improved/tidied using the scheme. CM

11. Resolution to adoption the Power of Wellbeing

a) Councillor R Dunn was presented with a certificate for attending POW training.

b) The Council resolved to adopt the Power of Well Being having sufficient trained Councillors to ensure that they are eligible under Local Government and Public Involvement in Health Act 2007 s77.

12. Environment

a) Youth Shelters – Councillor Martin has visited Weedon Bec and spoken to the Clerk Sue Halkett about funding. There is money available from Money4Youth but applications need to be made by young people supported by an organisation such as the Parish Council.

R Dunn reported that Willoughby Youth Shelter cost £3,000. The Clerk was asked to contact County Councillor R Brown, and DDH to ask for a grants.

It was agreed to put a note in KK for parents to ask teenagers to contact R Chamberlain if they would be keen to have a Youth Shelter. Clerk to forward pictures of Youth Shelters to C Mills.

b) Broadband - A small village in the Midlands has taken on BT at its own game, offering
fibre services to 200 homes. <

Councillor Mills reported that her neighbour is happy to advise the Council. She agreed to invite him to the next Parish Council meeting and ask him to brief Councillors on the options for improving broadband. CM

E Taken pointed out that the development of the BT site may mean that broadband supply is improved.

c) It was reported that the litter pick was successfully completed. A letter of thanks to be sent to the Guides and thanks to M Cahill for arranging this. CPRE are happy for Kilsby Parish to keep the bin liners and gloves etc. These are available from Councillor Cahill if anyone wishes to collect litter.

d) Flyposting. – It was agreed to write to all village organisations and ask them to remove posters after the event has taken place. If this does not happen then PCSOs will be asked to issue fixed penalty notices.

e) Christmas Tree- The Christmas Tree committee to be asked to remove the dead tree. Clk.

19. Cemetery

a) Councillor Cahill reported that Mr Lee is agreeable in principle to an extension of the cemetery up the hill behind the current area, and would be prepared to sell a similar sized area of land. The land is let until December 2011.

Legal expenses will be approx £500.

Councillor Smedley to draft a letter to Mr Lee and to arrange a valuation by District Valuers.

Councillors Smedley, Cahill and the Clerk to progress this. CS/MC/Clk.

b) It was agreed to update the paperwork issued to Undertakers to ensure that a signed agreement is returned stating they agree to the rules and fees of the cemetery and an address of the family is kept on record. A copy of public liability cover for Grave Diggers to be requested.

d) Report on Internal Audit for 2009/2010 was given and points raised were discussed.

e) Annual Review of Standing Orders and Financial Regulations. Cllr E Taken agreed to review the current Standing Orders and Financial Regulations to ensure they are in line with NALC Standing Orders 2010.

f) Review of Annual Insurance Cover for adequacy to be carried out, and the Asset register to be updated prior to payment of premium. Cllr Taken agreed to undertake this job. ET

g) The Annual Return to Auditors and Statement of Accounts and Annual Governance statement for year ending 31 March 2010 was approved and signed by the Chairman.

h) Mr Jim Goodger was reappointed as Internal Auditor for 2010/2011.

i) Internal Audit Report for Year ending 31 March 10 was read out and approved.

j) Annual Audit Return date has been set as 2nd July 10.

16. Planning

1. NEW APPLICATIONS

      • a) DA/2010/0344 Replacement of existing pre-school unit with new single storey pre -

      • school unit, with associated external works and new fencing. Kilsby C Of E Pre-School.

The Parish Council SUPPORT this application as it will help secure the future of both the Pre-School and Primary School.

b) DA/2010/0285 Installation of two standard loading docks. Unit C DIRFT. No observations.

c) Appeal by Yelvertoft Wind Farm. Amended drawings received. KPC did not wish to comment.

2. APPROVALS or REFUSALS

a) DA/2010/0240 Renewal of Outline permission for dwelling 11 & 15 Malt Mill Close. Granted.

b) DA/2010/0239 Construction of substation and cable route. Tesco Stores, DIRFT. Granted.

3. Decisions Awaited:

a) b) Planning Appeal APP/Y2810/A/10/2120332/NWF Yelvertoft Windfarm Land adjacent Glebe Farm, Hillmorton Lane, Yelvertoft. Planning Appeal date 22 June 10 at 10am DDC.

4. Other Planning Matters

a) Barby Sporting Club- Date for a meeting with DDC to be arranged when their new Acoustic expert takes office next week. R Chamberlain said that BSC will be invited to the meeting.

It was reported that they have started construction of the bunding.

17. Highways

i) Report of any new problems. R Dunn said he is pursuing the usual pothole repairs.

ii) A5/A361 Kilsby Roundabout Sponsorship –

Lasalign, Just Stoves and Kilsby Village Stores are all keen to have an advertising board on the A5 roundabout. The Clerk to contact AOne+ to ensure that signs 3ft x 2ft will be allowed. If this is agreeable to AOne+ the potential sponsors to be contacted and Advertising Consent sought.

Lasalign wish to have an advert on A5 travelling south, Just Stoves wish to have an advert on A5 travelling north, and Kilsby Village Stores will have the A361 entrance onto the roundabout.

Kilsby Village Stores wish to erect a fingerboard sign post on the verge at the top of Rugby Rd.

It was agreed that Mr Humphreys of Kilsby Village Stores could erect a fingerboard sign post in the Parish verge at a point to be agreed with KPC. A mock up of size, type and wording and fixing post to be submitted to the Council for approval prior to permission being granted.

The Village Hall committee to be informed when a mock up is received.

iii) Note regarding repairs of Gas Main on Ashlawn Road, Rugby were received. Now complete.

iv) Update on section 106 monies and works. £210,000 has been paid by Pro Logis to DDC, who have no record of receiving it. Cllr C Lomax to pursue this and R Chamberlain to request the payment details from Pro Logis. A meeting has been arrange for 14 June at 2pm to discuss progress on works.

v) Mowing at Haddons Forge, Daventry Road opposite Malt Mill Green. A query was raised by a resident as to why grass is not cut at the edge of Butts Lane. The bridleway will be kept clear by NCC but until KPC register ownership of Butts Lane it is not on the mowing contract.

vi) DDC has refused to allow Kilsby to mow grass on their behalf and receive the financial contribution they would have spent if they had done it. DDC have agreed to pay for the first cut carried out by S Hartwell since they were late in informing the parish that they would continue to cut Devon Ox.

It was agreed to claim the cost of the first cut, and write and complain to the CEO asking for the right to provide a better service for the parishioners than Daventry is able to deliver. Clk.

vii) Anglian Water to be contacted regarding 3 concrete near Pytchley Gardens.

18. Village hall.

a) Councillor Mills reported that the Quality Council certificate can be displayed in the hall.

b) It was reported that a street light is not working correctly. VP to report to E.ON. VP

c) It has been agreed in principle that the Pre-School can use the Village Hall until their new building is ready at the end of October.

d) Village Hall trustees were asked to phone “Street-Doctor” re: resurfacing of the driveway.

20. Rights of Way a) No problems to report

21. Lights a) The new column in Essen Lane has been installed.

22. Communication

a) Councillor Surgery 17th APRIL R Chamberlain reported that no one attended.

It was agreed to hold one last surgery on 12th June, which Councillor Mills offered to attend after which, if there was no interest, the surgeries would be abandoned and residents asked to attend Council meetings if they have issues they wish to alert the Councillors to.

APPENDIX Public Participation Tuesday 11th May 2010

The Chairman congratulated Councillor B Lomax on his return to serve another 4 years as a District Councillor.


1. Report from District Councillor B Lomax
Cllr Lomax reported that there has been very little Council business carried out due to the purdah period leading up to Elections.


Planning Site visits are being restricted to deny access to the general public, so local parish representatives can no longer attend. Councillor Lomax is raising this issue since he feels that local knowledge should be heard as part of open government.


Mr Lomax thanked the 78% of people who turned out to vote, and vowed to continue to serve the Ward to the best of his abilities.

2. Report from District Councillor C Lomax

Councillor Lomax reported that she had attended a training session on “Project Environmental Services” for outsourcing Waste Management, Country Parks and Maintenance.

DDC grass cutting will be cut to a “Suitable standard” so this does not bode well for service levels.


Daventry District Housing was inspected by the Audit Commission and got 2* out of 3 which was felt to be very good.


The Electoral Commissionaire attended the Election and visited Kilsby during Polling Day.


The Scrutiny and Improvement Committee has scrutinised the Leisure Centre. Mrs Lomax is waiting to see if a sanitised version of the report will be released, which makes a mockery of scrutiny.


Nothing more to report on Bus Tokens and subsidised transport.


Section 106 money.

Mrs Lomax has ascertained that ProLogis was invoiced on 22 February and the invoice was due on 8th March to be paid by Bank Transfer. DDC say they have not received the money.


Rob Chamberlain reported that Pro Logis contacted him to say the money has been paid. He has left a message with the Managing Director to follow up what has happened to it.


Mrs Lomax was asked to speak to DDH as cement is being delivered to the Smarts Estate houses which are being renovated and left on the street all night. Also the hedges have been demolished.


3. Police Report – PCSO Les Conopo

Kilsby and Crick have been very quiet although Biffa has been burgled.

Ops Guardian has meant that the PCSOs have spent some time in the Primary School.


PCSO Conopo said he will monitor vehicles travelling the wrong way down Essen Lane.


PSCO Conopo was thanked and left the meeting at 20.25.
